CAPSULE AGENCY Official Online Store Terms of Use
These Terms of Use (the "Terms") set out the conditions for using the online shop (the "Service") provided on this website by CAPSULE AGENCY Official Online Store ("we", "us" or "our"). Registered users ("Users") must use the Service in accordance with these Terms.
Article 1 (Application)
These Terms apply to all relationships between Users and us concerning the use of the Service.
In addition to these Terms, we may establish rules for use and other provisions for the Service ("Individual Provisions"). Regardless of their names, these Individual Provisions form part of these Terms.

For the Service, registration is complete when an applicant agrees to these Terms, applies for registration by the method we specify, and we notify the applicant of our approval.
We may decline to approve an application for registration if we determine that any of the following applies to the applicant, and we are under no obligation to disclose our reasons.
The applicant provided false information when applying for registration
The application is from a person who has previously violated these Terms
Any other case in which we determine that registration is not appropriate
Article 3 (Management of User IDs and Passwords)
Users are responsible for managing their user ID and password for the Service.
Users may not, under any circumstances, transfer, lend or share their user ID and password with any third party. If a login is made with a combination of user ID and password that matches the registered information, we will treat it as use by the User who registered that user ID.
We accept no liability for any damage caused by the use of a user ID and password by a third party, except where we are at fault intentionally or through gross negligence.
Article 4 (Sales Contracts)
For the Service, a sales contract is formed when a User applies to purchase from us and we notify the User that we accept the application. Ownership of the product passes to the User when we hand the product over to the delivery company.
If a User falls under any of the following, we may cancel the sales contract referred to in the preceding paragraph without prior notice to that User.
The User has violated these Terms
Delivery of the product cannot be completed because the delivery address is unknown or the recipient is absent for a long period
Any other case in which we consider that the relationship of trust between us and the User has been damaged
Payment methods, delivery methods, how to cancel a purchase application, how to return products and other matters concerning the Service are as separately specified by us.
Article 5 (Intellectual Property Rights)
Copyright and other intellectual property rights in product photos and other content provided through the Service ("Content") belong to us, content providers and other legitimate right holders. Users may not reproduce, republish, modify or otherwise make secondary use of the Content without permission.
Article 6 (Prohibited Acts)
When using the Service, Users must not engage in any of the following acts.
Acts that violate laws and regulations or public order and morals Acts related to criminal activity
Acts that infringe copyrights, trademarks or other intellectual property rights included in the Service
Acts that destroy or interfere with the functions of our servers or networks
Acts of using information obtained through the Service for commercial purposes
Acts that may interfere with the operation of our services
Acts of gaining or attempting to gain unauthorized access
Acts of collecting or storing personal information about other Users
Acts of impersonating other Users
Acts of directly or indirectly providing benefits to antisocial forces in connection with our services
Any other acts that we consider inappropriate
Article 7 (Suspension of the Service, etc.)
When using the Service, Users must not engage in any of the following acts.

Article 8 (Restriction of Use and Deletion of Registration)
If any of the following applies, we may, without prior notice, restrict a User's use of all or part of the Service or delete the User's registration.
The User has violated any provision of these Terms
Any registered information is found to be false
The credit card registered by the User as a payment method has been suspended
The User has failed to pay fees or other amounts owed
The User has not responded to our communications for a certain period
The User has not used the Service for a certain period since the last use
Any other case in which we determine that use of the Service is not appropriate
We accept no liability for any damage caused to Users by actions we take under this Article.
Article 9 (Withdrawal)
Users may withdraw from the Service by following the prescribed withdrawal procedure.
Article 10 (Disclaimer of Warranties and Limitation of Liability)
We do not warrant that the Service is free from defects in fact or in law (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose or security, as well as errors, bugs and infringement of rights).
We accept no liability for any transactions, communications or disputes that arise between a User and another User or a third party in connection with the Service.
Article 11 (Changes to the Service, etc.)
We may change the content of the Service or discontinue the Service without notifying Users, and we accept no liability for any damage caused to Users as a result.

Article 16 (Governing Law and Jurisdiction)
These Terms are governed by and interpreted under the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods does not apply to the Service.
Any dispute arising in connection with the Service is subject to the exclusive agreed jurisdiction of the court having jurisdiction over the location of our head office.
